ԽՄԲԱԳՐԻ ԸՆՏՐԱՆԻ

Սահմանադրական դատարանը հրապարակեց ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի և Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի դատավոր Դավիթ Գրիգորյանի դիմումների հիման վրա ՀՀ Քրեական օրենսգրքի 300.1-ին հոդվածի՝ Սահմանադրությանը համապատասխանելու հարցով որոշումը։ Ըստ այդմ՝

«ՀՀ ՍԴ-ն քննելով դիմումները որոշեց ՀՀ Քրեական օրենսգրքի 300.1 հոդվածը ճանաչել սահմանադրության 78-79 հոդվածներին հակասող ու անվավեր: Սահմնանադրության 170-րդ 2-րդ մասի համաձայն սույն որոշումը վերջնական է և ուժի մեջ է մտնումհրապարակման պահից»,-որոշումը ներկայացրեց ՍԴ նախագահ Արման Դիլանյանը:

Նա նաեւ տեղեկացրեց, որ ՍԴ դատավոր Խունդկարյանը սույն գործով հատուկ կարծիք ունի պատճառաբանական մասին վերաբերյալ:
